Please read these Terms of Service (“Terms”) carefully before using the website or services of Friendly Dumpster Rental (“Company,” “we,” “our,” or “us”), located in Troy, Michigan. By accessing our website, requesting a quote, placing a rental order, or otherwise using our services, you (“Customer” or “you”) agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Friendly Dumpster Rental. These Terms apply to all visitors, users, and customers who access or use our website or rental services. By using our services, you represent that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with all applicable local, state, and federal laws and regulations.

2. Services Provided

Friendly Dumpster Rental provides temporary roll-off dumpster rental services in Troy, Michigan and surrounding areas. Our services include:

Delivery of rented dumpster containers to customer-specified locations
Pickup of dumpster containers following the rental period
Hauling and disposal of accepted waste materials
Online and phone-based quote requests and order placement

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

3. Rental Orders and Reservations

A. Order Placement

Rental orders may be placed through our website, by phone, or by email. All orders are subject to availability. Receipt of an order confirmation does not guarantee availability; we will notify you promptly if your requested equipment or dates are unavailable and work to find a suitable alternative.

B. Accurate Information

You agree to provide accurate, complete, and current information when placing an order, including your service address, contact information, and billing details. You are responsible for any errors or delays resulting from inaccurate information provided.

C. Rental Period

The standard rental period is stated at the time of booking. If you need the dumpster for additional days beyond the agreed rental period, you must notify us in advance. Extended rental periods are subject to additional daily fees. We reserve the right to schedule pickup at the end of your rental period without additional notice.

4. Payment Terms

A. Pricing

All prices are quoted in U.S. dollars. Quoted prices are based on information provided at the time of booking, including dumpster size, rental duration, service area, and estimated weight. Final charges may differ from initial quotes if actual conditions differ from those estimated.

B. Additional Charges

Additional fees may apply in the following circumstances:

Overweight fees: If the total weight of materials disposed exceeds the included weight limit for your rental
Extended rental fees: For each day the dumpster is retained beyond the agreed rental period
Prohibited materials fee: For disposal of items that require special handling or that were not disclosed at the time of booking
Relocation fee: If we are asked to move the dumpster after delivery
Failed delivery fee: If delivery cannot be completed due to inaccessible or unsafe conditions at the customer’s property
Contamination fee: If the dumpster contains materials that contaminate an otherwise acceptable load

C. Payment

Payment is due at the time of booking unless alternative arrangements are agreed to in writing. We accept major credit cards and other payment methods as displayed on our website. You authorize us to charge your payment method for all fees incurred, including any applicable additional charges described above.

D. Late Payments

Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month (18% annually) on the outstanding balance, or the maximum rate permitted by Michigan law, whichever is less. You agree to pay all reasonable costs of collection, including attorney’s fees, if collection efforts become necessary.

5. Delivery and Placement

A. Site Access and Preparation

You are responsible for ensuring that:

The delivery site is accessible to our trucks at the scheduled delivery time
The placement area is on a hard, level surface capable of supporting the weight of a loaded dumpster
Overhead clearance is sufficient for safe delivery and pickup
Any necessary permits from local authorities have been obtained prior to delivery

B. Driveway and Property Damage

While we take reasonable precautions during delivery and pickup, dumpster containers are heavy and may cause cracking or damage to asphalt, concrete, or pavers. By accepting delivery, you acknowledge this risk and agree that Friendly Dumpster Rental is not liable for surface damage resulting from normal delivery and pickup operations. Placement of wood boards or protective material under the container is the customer’s responsibility if damage prevention is a concern.

C. Public Property and Permits

If you request placement of a dumpster on a public street, sidewalk, or right-of-way, you are solely responsible for obtaining any required municipal permits before delivery. Fines or penalties assessed by any governmental authority related to dumpster placement are the customer’s responsibility.

6. Acceptable and Prohibited Materials

A. Generally Accepted Materials

Our dumpsters are suitable for general household and construction debris, including furniture, appliances (see restrictions below), yard waste, roofing materials, concrete, wood, drywall, and similar non-hazardous materials. Specific weight and material restrictions apply to each dumpster size; please ask at the time of booking.

B. Prohibited Materials

The following materials are strictly prohibited and must NOT be placed in our dumpsters:

Hazardous waste of any kind, including asbestos, lead paint, and contaminated soil
Flammable or explosive materials, including gasoline, propane tanks, and solvents
Chemicals, pesticides, herbicides, and pool chemicals
Paints, stains, and varnishes (unless fully dried and solidified)
Batteries (automotive or household)
Tires
Medical or biohazardous waste
Electronic waste (e-waste), including televisions, computers, and monitors
Freon-containing appliances (refrigerators, air conditioners, freezers) unless freon has been professionally removed and documented
Liquid waste of any kind
Railroad ties and treated lumber containing hazardous preservatives

You are responsible for all costs, fines, penalties, and cleanup expenses resulting from your inclusion of prohibited materials. We reserve the right to refuse pickup of or charge additional fees for any load containing prohibited materials.

7. Customer Responsibilities

As a customer, you agree to:

Use the dumpster only for lawful purposes and in accordance with these Terms
Not overload the dumpster above the fill line or beyond the stated weight limit
Ensure the dumpster is accessible for scheduled pickup
Not move or relocate the dumpster after delivery without our prior written consent
Not allow others to use the dumpster without your supervision
Notify us immediately of any damage to the dumpster or safety concerns
Keep the area around the dumpster clear of obstructions during the rental period

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FRIENDLY DUMPSTER RENTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any claims arising out of or related to these Terms or our services shall not exceed the total amount paid by you to us for the specific rental giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in their entirety.

9. Indemnification

You agree to indemnify, defend, and hold harmless Friendly Dumpster Rental, its owners, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:

Your use of our services or website
Your violation of these Terms
Your placement of prohibited materials in the dumpster
Any damage to property or injury to persons caused by your use of the dumpster
Your failure to obtain required permits
Any inaccurate information you provided to us

10. Website Use

A. Permitted Use

You may use our website only for lawful purposes and in accordance with these Terms. You agree not to use our website in any way that violates applicable laws, transmits spam or unsolicited communications, attempts to gain unauthorized access to our systems, or interferes with the proper functioning of our website.

B. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Friendly Dumpster Rental or its content suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

C. Accuracy of Information

We strive to keep the information on our website accurate and up to date, but we make no warranties or representations regarding the completeness, accuracy, or reliability of any content. Pricing displayed on the website is subject to change without notice and is not a binding offer until confirmed in writing.

11. Disclaimer of Warranties

OUR SERVICES AND WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Governing Law and Dispute Resolution

A. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Oakland County, Michigan.

B. Dispute Resolution

We encourage you to contact us first to resolve any concerns. If a dispute cannot be resolved informally, both parties agree to attempt non-binding mediation before initiating formal legal proceedings. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.

C. Waiver of Class Action

To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class action, consolidated, or representative action.

13. Force Majeure

Friendly Dumpster Rental shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, severe weather, natural disasters, government actions or restrictions, labor disputes, supply chain disruptions, or any other event outside our reasonable control. In such cases, we will notify you as soon as practicable and make reasonable efforts to reschedule your service.

14. Cancellation and Rescheduling

Cancellation and rescheduling policies are as follows:

Cancellations made 48 or more hours before the scheduled delivery: Full refund, no cancellation fee
Cancellations made less than 48 hours before the scheduled delivery: Subject to a cancellation fee equal to the delivery charge
Rescheduling requests are subject to availability and must be made at least 24 hours in advance
No-shows or refused deliveries: Subject to a failed delivery fee

We reserve the right to cancel or reschedule any order due to unsafe conditions, equipment unavailability, or other circumstances beyond our control. In such cases, you will receive a full refund or rescheduled service at no additional charge.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the revised Terms on our website with an updated “Last Updated” date. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically. For material changes, we may provide additional notice via email or a prominent notice on our website.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any rental confirmation or order acknowledgment, constitute the entire agreement between you and Friendly Dumpster Rental with respect to your use of our services and website, and supersede all prior agreements, representations, and understandings. No waiver of any provision of these Terms shall be effective unless in writing and signed by an authorized representative of Friendly Dumpster Rental.
